Terms and Conditions: General Info

Most Important^{☆ Commissioned artwork by NeciaHeda is forbidden to be used for AI apps/software, NFTs, or crypto.}^{☆ MUST be 18+ yrs old to commission.}^{☆ Commission artwork is delivered to you digitally!
Via Dropbox, Google Drive, Discord, email or another preferred method. Files may become unavailable after 1 month from when it was sent. I am NOT responsible for your files.}^{☆ I do not work Saturdays + Sundays.}^{☆ I have every right to decline your commission.}^{☆ Wait-time changes depending on queue. Please check schedule to stay up to date.}^{☆ Required to credit @NeciaHeda}^{☆ All commissions are for personal use ONLY, unless a commercial use fee has been purchased.
Streamer assets such as Emotes, Badges, Character Sheets, and Room/Overlays include FULL commercial use*.

The Process:^{☆ Commission Accepted
Once I've viewed your request form and accepted your commission. I will send an invoice via Paypal or email.}^{☆ Wait-listed
Depending on queue your commission may be wait-listed. Once a few slots have cleared, I will reach out and let you know I'm ready to start and send the invoice.}^{☆ Sending Invoice
I do not start any commission without receiving full payment first. Will accept half now + half later payments for commissions over $150 USD}^{☆ Sketching
Sketching will begin soon as possible. Please check schedule to see where you're at in my queue.
I will reach out if I need any feedback or once the sketch is complete.}^{☆ Approval or revisions.
Once the sketch has been sent you can make as many changes as you'd like til approval. (As long as the changes are still true to original concept.)}^{☆ Lining + Coloring
NO line changes can be made once in lining + coloring phase.
I may ask for your approval for base colors.}^{☆ Finalizing
Once full render is complete illustration is sent out to client.}^{☆ Posting
ALL commissions are posted PUBLICLY to my social media, discord, Ko-fi, and schedule board.
If a commission is to be kept private, it is YOUR responsibility to notify me BEFORE sketching process*.

Payment + Refund Policies

^{☆ All payments are sent via PayPal invoice.}
^{All invoices must be paid in full within 10 days.}^{☆ I do not accept refunds on started or finished commissions.}
^{FULL refunds are only eligible on commissions I have not yet started sketching.
Check if commission is in sketching process at schedule}Refund Shipping Policies:
^{This only applies to physical goods.}^{☆ If you have given me the wrong/incorrect address you and need another shipping label created, I'll charge for another shipping label.}
^{Once tracking number is created I'm NOT responsible for any lost, stolen, or damaged items.}^{☆ I accept partial refunds on shipped items.}^{☆ I accept exchanges on shipped items.}

Digital Delivery Policies

^{☆ Completed commissions are sent via Dropbox link, Google Drive, Discord file attachment, or email attachment.}
^{- After a month, the file will be deleted from my Dropbox/GoogleDrive and you'll be unable to redownload the file.}^{☆ Files are sent in Zip Folder format.}^{☆ I am not responsible to keep all your art files! I may not have your files as I do not keep commissions forever.}^{KEEP IN MIND If at any moment you lost/deleted the files and files can be recovered, there is a $35 USD recovery fee.}

COPYRIGHT + COMMERCIAL TERMS

^{I, the artist, retain original copyright and ownership of the artwork.
Which may include, but may not be limited to to redistributing, reproducing, self-promo,
displaying the artwork in any websites, social media and portfolios unless agreed upon.}^{☆ Use of the commissioned artwork with any kind of AI image editor or similar software is strictly prohibited. REGARDLESS with commercial use is purchased!}^{☆ I reserve the right to watermark my artwork.}^{☆ You or another artist are not allowed to alter or trace artwork without my permission.}^{☆ You are NOT allowed to resell the artwork. If you plan on reselling the artwork, it is required to give credit. Resell price MUST be the same or less of what you originally paid.}

Basic Commercial Use Info:^{If you plan on using the commission for commercial use a $50 fee is applied per design illustration.}
^{Streamer assets such as Adoptables, Emotes, Badges, Character Sheets, and Room/Overlays include FULL commercial use.}^{☆ Upon purchasing commercial use you, the client, have rights to redistributing, reproducing, advertising, displaying the artwork in your websites, social media.}^{☆ Credit is still required with commercial artwork.}

^{Breaking any of these terms will forefit all rights back towards me, the artist.}

Adoptable Terms

^{Adopts may be listed in NeciaHeda's Ko‑fi Shop, once purchased listing will be marked as SOLD and possibly removed in the near future.}^{☆ I do not accept refunds once adopt has been purchased.}^{☆ Adopt design file(s) are automatically sent through NeciaHeda's Ko‑fi Shop. Be sure to save a back-up! NeciaHeda is not responsible for lost files.
If you did not receive files, please contact me.}^{☆ Anyone who owns an adopt made by me, NeciaHeda, will receive 10% OFF on commissions containing that adoptable character.}Adoptables Can Be..^{☆ Used for personal and commercial use.}^{☆ Edited after purchased. Go ahead feel free to change the skin tone, body type, and outfit(s).}^{☆ If you plan on editing the character, please keep it recognizable.}^{☆ Re-sold, traded, or gifted. Please contact me with who the new owners are!
If re-selling please wait at least 3 weeks to resell at the same price or higher (if more artwork is included or redesigned).}

Discount Policy

^{☆ Discounts can only be applied to Ko-fi and Google Form requested commissions.}^{☆ Ko-fi discounts are automatically applied on shop items and commissions.}^{☆ Anyone who owns an adopt made by me, NeciaHeda, will receive 10% OFF on commissions containing that adoptable character.}Commissions CANNOT be applied to:
^{- REDOS or EDITS}
^{- RUSH ORDER Commissions}

Private Commissions

^{☆ For private commissions, you MUST state that your commission is private during ordering process.}^{☆ If you request your commission is private I will not stream, post WIPs, or post final piece onto social media unless stated otherwise.}^{☆ Please let me know when you're ready for the private commission to go public.}^{☆ Credit is STILL required once commission is posted publicly.}
